How the dates are calculated

Business days exclude Saturdays, Sundays, and U.S. federal holidays (including observed dates when a holiday falls on a weekend). The open negotiation initiation window is the 30-business-day period beginning on the day the initial payment or notice of denial is received. The open negotiation period is the 30-business-day period beginning on the date open negotiation is initiated. The federal IDR initiation window is the 4-business-day period beginning on the business day after the open negotiation period ends. The cooling-off period runs 90 calendar days from a payment determination; claims whose initiation deadlines lapsed during the cooling-off period may generally be initiated during the 30-business-day period after it ends. The No Surprises Act regulations do not define “business day”; excluding federal holidays reflects standard federal practice and CMS operational practice.
